RELEASE AND WAIVER.
In consideration of Purity Cylinder Gases Inc. providing equipment demonstration, instruction, and training services, and for other good and valuable consideration, I (the “Releasee”) hereby agree to release, waive, and forever discharge any and all liability, claims, suits, and demands of whatever kind or nature against Purity Cylinder Gases, Inc., including its officers, directors, employees, agents, and representatives to the fullest extent permissible by law, including but not limited to damages or losses caused by the direct or indirect negligence, fault, or conduct of any kind on the part of Purity Cylinder Gases, Inc., including but not limited to death, bodily injury, illness, economic loss or out of pocket expenses, or loss or damage to property, which I may have or which may hereinafter accrue, which arise or may hereafter arise from the demonstration, training, instruction, observation, handling, setup, or operation of equipment provided or demonstrated by Purity Cylinder Gases, Inc. I acknowledge that participating in equipment demonstrations and training involving industrial equipment and systems involves known and unanticipated risks which could result in injury, death, and property damage. I expressly accept and assume all the risks inherent in such demonstrations and training or that might have been caused by Purity Cylinder Gases, Inc. I elect to participate in the demonstration and training activities despite the risks.
INDEMNIFICATION AND HOLD HARMLESS AGREEMENT.
The undersigned agrees to indemnify and hold harmless Purity Cylinder Gases, Inc., including its officers, directors, employees, agents, and representatives from any loss, liability, damages or costs they may incur, resulting from the demonstration, training, instruction, observation, handling, setup, or operation of equipment, whether caused by the direct or indirect negligence, fault, or conduct of any kind on the part of Purity Cylinder Gases, Inc. The undersigned understands and agrees that Purity Cylinder Gases, Inc. is not required to provide insurance to cover the undersigned in the event of death, bodily injury, illness, economic loss or out of pocket expenses, or loss or damage to property resulting from the equipment demonstration or training activities.
I have carefully read and understand the terms of this Liability Waiver and Release of All Claims, Assumption of Risk, and Indemnification Agreement. I understand that this document is a promise not to sue and a release of and indemnification for all claims.
